Standard contractual clauses – need for change

The European Commission Decision of 31 January 2011 on the adequate protection of personal data by the State of Israel with regard to automated processing of personal data applicable only to personal data transferred from the EU in connection with automated international transfers of personal data from the EU.

For other forms of processing, Standard Contractual Clauses (SCC) may be one method of legalising the transfer.

Please note that failure to implement the new SCCs by the above deadline may involve the following risks:

  1. regulatory/legal risk – administrative financial penalties imposed by the supervisory authority;
  2. PR risk – reputational damage caused by a penalty or public information on inadequate protection of personal data transferred outside the EEA;
  3. business risk –  loss of business partners’ trust due to inadequate personal data protection.
